Duplicate abilities can only arise as a result of partial genetic inheritance of the mangekyo's traits - Itachi and Sasuke share Amaterasu, but where Itachi has Tsukuyomi in the other eye, Sasuke has Kagutsuchi, letting him use amaterasu for shaped applications.

EMS probably lets you use the other guy's mangekyo powers, considering that some rando who had them implanted and isn't an Uchiha can use those.
