Do I label this for pedophilia?

    I've been considering a story, but a part of the setting is that it works more with Western Australia ages of consent (that is to say, 16+) as opposed to the American ones (that is to say, 18+). Should I label that as pedophilia in the tags, or is there a different tag for stuff like that?

    Because we don't actually care care... if you label it loli or shota. Because it's just words and not actual pedo pictures.

    It's a fanfic, they are established characters, and mention of their age is made once. There will potentially be a picture or two, but they won't be NSFW in nature. Mostly wondering if I have to explicitly label it since it's not... America-compliant? I suppose?

    Note that photographic NSFW images of people under 18 are still forbidden per US law. Drawn images of fictional characters, and written text, are both fine.

    Come to think of it: While this isn't that relevant for the story in question, does it count if the person depicted in the photographic image is under 18, but the individual portraying the person isn't (basically, cosplay)?

    If the REAL PERSON is an adult, it's okay to my understanding.

    Just avoid actual underage people and you should be good?


    Though the uncertainty is probably why most people tend to stick to 2d characters, which are always fine.

    If the pic is actually 18, but text on pic say she's under, we automatically can your ass. We did that before. So don't even make jokes about this.

    Got it, so in case of using cosplay, should I link to the cosplayer themselves too to show that they are, in fact, 18+? Their profiles and whatnot?

    Actually, the US federal age of consent is also 16. The meme of it being 18 is because California has a state age of consent of 18 and California dominates US media.

    I believe it's also part of state law that requires all depictions to abide by California state law, too. So they can't show a 17yo with a 19yo, even if that would be legal in whatever state the story claims it takes place in.

    Ages of consent vary, but NSFW photos of someone under 18 are always illegal (under US federal law). That's really the most relevant concern for a case like ours.

    I thought it was because 18 is the age of majority, which means you are legally allowed to show up on camera in porn.

    Like, when they say Barely Legal 18 Years Old, they mean barely legal to be in porn, not to have sex.

    But people associate porn with sex, so "18 is legal age" gets stuck in their heads for both.


    (Plus, that jibes with the requirements we're seeing from staff here: ensure that any humans who show up on camera in anything even vaguely porn-related are at least 18.)
